By accessing or using the Services, you acknowledge and agree to the terms of this Policy and consent to the processing of your data as described herein.

Additionally, data is processed to enhance the efficiency, accuracy, and personalization of the Services, particularly in relation to artificial intelligence-driven translations.

Users acknowledge and agree that such anonymized data may be retained indefinitely for purposes including, but not limited to, software enhancement, performance optimization, and algorithmic training.

Depending on your location, you may have the right to access, update, or request the deletion of your personal data. Opt out of marketing emails and communications. Restrict or object to certain types of data processing.

Welcome to Menuwiz. These Terms of Service ("Terms") govern your use of our website, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Account Responsibi

You must be at least 13 years old to use Menuwiz. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2. Use of the Service

Menuwiz provides AI-powered translation and recognition services for food-related content, including menus, ingredient lists, and product descriptions. You agree to use the Service only for lawful purposes and in accordance with these Terms.

3. AI-Generated Content Disclaimer

Menuwiz uses artificial intelligence, including models provided by third-party providers such as Google/Alphabet, to generate translations and other content. While we strive for accuracy, we cannot guarantee the correctness or appropriateness of AI-generated information. We do not have complete jurisdiction over the data used to train base AI models provided by third parties.

You understand and agree that:

    Some translations or content may be incomplete, outdated, or inaccurate.

    The Service is not a substitute for human expertise, especially in sensitive or high-stakes contexts.

    You use AI-generated content at your own discretion and risk.

4. Privacy, Data Usage, and Compliance

Menuwiz collects and uses user data as described in our [Privacy Policy]. This includes information you submit through scans, uploads, and interactions with the Service.

We are committed to compliance with:

    GDPR (General Data Protection Regulation): You have the right to access, correct, delete, or restrict the processing of your personal data. You can request these actions via email.

    Japan’s Act on the Protection of Personal Information (APPI): We take measures to safeguard personal data of users in Japan, including limited use, notification, and secure storage.

Data Security and Proprietary Information:

    Menuwiz does not sell data used to train our original UI or internal systems.

    We maintain strict confidentiality and security protocols for all proprietary data shared by partner institutions under contract.

    We use standard encryption and access control practices to protect all user and institutional data.

5. User Content and License

By uploading, scanning, or submitting content to the Service, you grant Menuwiz a worldwide, non-exclusive license to use, store, process, and analyze that content for the purposes of providing and improving our Service.

Anonymized data used for AI training and caching cannot be deleted or modified and is owned by Menuwiz.

6. Modifications and Availability

We may update these Terms at any time. If we make significant changes, we will notify you via email or in-app notice. Your continued use of the Service constitutes acceptance of the revised Terms.

We reserve the right to modify, suspend, or discontinue the Service at any time without liability.

7. Subscriptions, Presale Terms, and Refund Policy

7.1 Subscriptions and Presale Offerings

Menuwiz may offer paid subscriptions and presale access to future versions of the service. These offerings do not guarantee the quality, features, or specific delivery timeline of the service. However, they do guarantee that presale purchasers will receive access to the service if and when it successfully launches.

By participating in a pre-sale or pre-launch subscription:

    You acknowledge that the service is under development and may never be completed or launched in full.

    You understand that development outcomes can change and that technical, business, or regulatory challenges may prevent delivery.

    You waive your right to a refund in the event that Menuwiz is unable to deliver the service for any reason, including but not limited to development failure, business closure, or force majeure.
 
You acknowledge that screenshots and demo videos of the prototype may differ from any delivered product and are used for illustrative purposes only.


7.2 Beta Testing

If you participate in Menuwiz's beta testing program, you may receive free or promotional access. Menuwiz reserves the right to revoke or modify free plans at any time, including replacing them with paid subscription plans.

7.3 Retail and Bulk Purchases

Retail partners and resellers who purchase Menuwiz access codes, licenses, or translation credits in bulk waive their right to a refund upon initiating any resale or promotional efforts. Menuwiz assumes no liability for resale performance or customer satisfaction downstream.

7.4 No Guarantees on Speed or Quality

Menuwiz does not guarantee the speed, quality, or availability of its services at any given time. Service functionality may vary depending on demand, technical conditions, service environment, or ongoing updates.

"Commercial Disclosure

Item Type: Subscription service of digital application use    
Explanation: Users pay for AI credits and access codes to utilize a digital service for translations  and restaurant guidance.
Example: 800 yen for up to 7 days of use and a set number of usable credits. Exceeding this number may result in service throttling or suspension. Additional credits available for a fee.
Additional fees include (but are not limited to): credit card and convenience store processing fees, additional credit use fees for users who exceed allotted use time and volume.

Exchanges & Returns Policy    
As we offer downloadable software, users acknowledge that software may not offer the same performance on all devices and operating systems. Presale customers waive right of refund and return for the purpose of priority access to in-development software.
Future iterations will be subject to full and partial refund policies depending on the nature of the complaint or return reason. Exchanges are not possible due to the nature of the product. Opened subscriptions (limited to registered users) can be cancelled at the end of the service term (one week, 3 days etc.) or force cancelled immediately without refund from within the app. Prospective users can cancel payment at any time before completing checkout. Defective access codes will be replaced with a working one free of charge if the code is judged to be defective before the users first log-in session.

Currently, there is no refund for pre sale payments. For refunds of future iterations , please contact support.

Delivery times: Digital goods delivered upon completion of payment processing.

Accepted payment methods: Credit cards or via local bank transfer, certain mobile applications (Paypay, etc.). STRIPE accepted payment methods.

Payment period:  Credit card payments are processed immediately, while local bank transfers must be sent within 3 days of the date of order. Payment processing courtesy of STRIPE. Please check Stripe page for details.

Sales price of the product or service (including consumption tax): Amounts listed on each product page. Presale amount of 800 yen/access code limited to presale period.

Presale period: From May 1 to August 25, 2025, subject to change. Presale subscriptions are offered at a discounted retail value and cannot be refunded or exchanged.
